General and/or booking terms of Villa Upendi

1. Responsibilities

Villa Upendi cannot be held responsible for any disruption, alteration or obstruction of the tenant's stay if this results from unforeseen or insurmountable events beyond its control. Villa Upendi cannot be held responsible for inconveniences caused by the work of third parties, such as the municipality, province, etc. Likewise, Villa Upendi cannot be held responsible for interruptions of gas, water or electricity but will try to resolve this as soon as possible. Villa Upendi disclaims any responsibility for loss, theft or damage to luggage, personal belongings or vehicle, including costs, arising from failure to arrive at the villa on time due to delay.

2. Booking and price

A reservation is valid and definitive from the moment that Villa Upendi receives the required deposit. Paying this means that the tenant has taken notice and agrees with the general lease agreement mentioned here and the full description of the villa that he has rented. Villa Upendi's prices are calculated in euros and are per villa per day or other period, if so stated on the invoice. Costs for meals, drinks, etc. are never included in the price. Additional costs, such as energy usage above fair use, etc., are listed in the villa description and are never included in the price unless otherwise specified.

3. Payment of the rent

For each reservation, a 50% deposit of the rent must be paid. This deposit must be received by us within 5 days after booking on the website villaupendi.com. The remaining amount must be received by Villa Upendi no later than 8 weeks before the start of the stay in the villa. If this does not occur, the tenant will receive an email requesting payment of the balance within 5 days. If this payment does not happen, it will be regarded as a cancellation of the villa by the tenant and the cancellation terms of Article 4 apply. Villa Upendi will simultaneously have the right to offer the villa again for rental to others. If the reservation takes place less than 4 weeks before the start of the rental period, payment of the full rent must be made immediately. Upon receipt of the balance, you will receive a message from Villa Upendi. You must provide all necessary information concerning the address, name and phone number of the person who will receive the villa, as well as the address of the villa and “proof of access to the villa” to the person who will receive it.

4. Cancellation by the tenant

Each cancellation must be reported to Villa Upendi by e-mail. Villa Upendi will charge the following amounts, depending on the date of the tenant’s written cancellation:

● cancellation more than 8 weeks before the start of the rental period: 20% of the rent.

● cancellation between 8 and 4 weeks before the start of the rental period: 50% of the rent.

● cancellation less than 30 days before the start of the rental period: 100% of the rent.

If the tenant does not use the villa or leaves it before the end of the rental period, no refund will take place. The villa may NOT be sublet to other persons without written permission from Villa Upendi.

5. Cancellation by Villa Upendi

If, due to unforeseen circumstances such as the sale of the villa, Villa Upendi must cancel the lease agreement, the tenant will be notified immediately and a refund of deposits will take place. If the cancellation of the lease agreement is not a result of force majeure, Villa Upendi will also not pay any additional amounts from the rent, i.e., compensation for damage or inconvenience.

6. Complaints and disputes.

Any complaint will not be processed if it is not reported by phone to Villa Upendi within 48 hours after taking possession of the villa and is followed by a registered letter from the tenant. The same rule applies if something serious occurs during the stay in the villa. If the tenant refuses to take possession of the villa because its condition does not match what he reasonably expects, he must contact Villa Upendi immediately. If an agreement cannot be reached, the tenant must have the complaint verified by a qualified professional, a bailiff or a notary, in order to obtain an objective judgment. This contract is drawn up and must be interpreted in accordance with Dutch law. All disputes that may arise from this contract fall under the exclusive jurisdiction of the Dutch district court.

7. Description.

All detached information or information on the Villa Upendi website or other rental websites concerning the villa, its layout, furniture or the relevant facilities is provided in good faith, based on data from the owner or observed following on-site inspections by Villa Upendi. If a change occurs between the moment of reservation and the start of the rental period, Villa Upendi will inform the tenant, but will not be held responsible for this. If, despite everything, the information concerning the villa, layout, furniture, maximum number of occupants or the relevant facilities turns out to be incorrect, the tenant must immediately inform the landlord so that he can rectify the matter.

8. Arrival and departure

Arrival at the villa takes place daily between 15:00 and 17:00 unless otherwise agreed and confirmed. It is recommended to call the person who handles the reception an hour before arrival. If this procedure is not followed, Villa Upendi cannot be held responsible for not being able to take possession of the villa at the time the tenant arrives on site.

The villa must be vacated no later than 10:00 on the day of departure, or later if agreed in consultation with Villa Upendi.

9. Maximum number of occupants

No more than 6 persons may stay in the villa unless prior written permission has been granted by Villa Upendi. If this number is exceeded, the person handling reception may deny access to the villa to these extra persons. If, at a later time, outside the knowledge of the person handling reception, extra persons still stay in the villa, an immediate claim of 25% of the rent per extra person arises, which, if necessary, will be deducted from the security deposit or must be paid immediately.

10. Pets

Pets are NOT allowed in the villa.

11. Smoking

Smoking is NOT allowed inside the villa! It is allowed on the terrace.

12. Self-drilling.

It is absolutely prohibited to drill holes to hang personal items!

13. Security deposit

The amount of this security deposit is €300.00 and must be paid in advance. This deposit will be refunded within 4 weeks after leaving or the final inspection of the villa, possibly less costs for repair of any damage to the villa, inventory or additional electricity and/or cleaning costs.

14. Cleaning

The villa must be found clean and tidy upon arrival. If this is not the case, it must be reported immediately to the person handling reception so that they can rectify the matter. Additionally, the tenant must report this to Villa Upendi within 1 hour of arrival via e-mail or a WhatsApp message.

At departure, the tenant must leave the villa orderly and clean, and the household waste must be disposed of themselves. The public waste containers for this are located on the street.

15. Inventory

The inventory in the villa is NOT to be replaced by the tenant in order to preserve the uniformity. If something is broken, the tenant must report it to the landlord and pay the replacement cost.

A crib and/or baby chair are available upon request and for additional rental costs.

16. Internet / WiFi / Electricity

Internet/WiFi is included for free and a maximum of 15 kWh per day is included in the electricity cost; above that €0.35 per kWh. Any additional electricity usage will be charged against the deposit.
